SUPPOSITION

Richard and William BAXTER (brothers)
According to the IGI, a Richard BAXTER was baptised in Chaceley, 20 Feb 1634. His father was Richard BAXTER and his mother was Anne BERROWE who married in Chaceley on the 17th February 1633. His brother, William was baptised on 21 March 1637 in Chaceley and was buried in Tirley on January 23 1695. (Source: William Good transcriptions).

Margaret BAXTER (wife)
Margarett BAXTER widow was buried in Tirley on September 5th 1698 (Source: William Good transcriptions).

Mary, Richard, John and Anne BAXTER (children of Richard and Margaret)
The William Good transcriptions records the baptism of four children to a Richard BAXTER in Chaceley between 1661 and 1669. Mary BAXTER: 16 Sep 1661, Rich BAXTER: 23 Jan 1664 (see the will of Richard Baxter proved 1722), John BAXTER: 07 Jan 1666 and Ann BAXTER: 27 Jan 1669.

If a person died without leaving a will (intestate) and the estate was large enough or could not be divided by mutual agreement then application was made to the court for the appointment of an administrator/s to divide the estate. This permission was given by the court in the form of a Letter of Administration or Admons. Administrators were usually the next of kin of the deceased (a widow, child or brother) but creditors were sometimes appointed.

Since medieval times the law stipulated that widows should receive one third of the estate of an intestate; The Statute of Distributions 1670 provided that the residue should be divided equally among the children of the deceased. If the deceased had no children, next in line were the parents then siblings.

Admon also came into effect if a will was made naming no executors or the executors refused to act/died. Admon was then dealt with according to the terms of the will.

Admons usually contain limited information often consisting of the name, residence and possibly the occupation of the administrator appointed.

SUPPOSITION

Mary JELFE (sister in law)
There is a Mary married to a Samuel JELFE at Sandhurst abt. the right time who (according to the IGI) has 4 children - Samuel (bapt. 1669), Mary (bapt. 1672), Sarah (bapt. 1673) and Joane (bapt. 1677).

Mary HALLE (nephew)
According to the OED, nephew was used meaning niece up to 1585. GenBrit has an interesting thread concerning the usage of nephew. There is a reference to the marriage of a Mary JELFE in the Corse parish registers - Anthony HALLE and Mary JELFE being asked in church 18th July 1685 (Source: William Good transcriptions).

Richard BAXTER (nephew)
Walter appears to have a sister Anne JELFE (of Sandhurst) who in 1685 marries Richard BAXTER. Richard, the nephew of Walter JELFE and the son of Richard BAXTER and Anne JELFE was baptized on September 27 1687 in Tirley. Anne is buried two days after the birth (Source: William Good transcriptions). The Richard BAXTER who marries Anne seems likely to be the son of Richard BAXTER the Elder buried in 1695 (see the will of Richard BAXTER proved 1691).
